| dc.description | Access to justice in rural communities in Ecuador faces multiple challenges that limit the equity and effectiveness of the legal system in these areas. Among the main barriers are economic, geographic, and cultural barriers. The prevalent poverty in rural areas makes it difficult for residents to afford adequate legal services. Furthermore, the remoteness and lack of judicial infrastructure in these regions impede timely access to justice, exacerbating the feeling of exclusion among residents. A lack of confidence in the judicial system—driven by concerns over corruption and lengthy bureaucratic procedures—has led rural communities to avoid turning to formal legal channels. To address this, alternative approaches like Indigenous justice and the role of Justices of the Peace have been established. The Constitution of Ecuador grants Indigenous authorities the power to settle internal disputes based on their traditions and customs, fostering community involvement and social cohesion. Likewise, since 2015, Justices of the Peace have handled over 15,000 cases in rural and marginalized urban regions, offering accessible, efficient, and community-oriented solutions to conflicts. | es_ES |
| dc.description.abstract | El acceso a la justicia en las comunidades rurales de Ecuador enfrenta múltiples desafíos que limitan la equidad y eficacia del sistema legal en estas áreas. Entre las principales barreras se encuentran las económicas, geográficas y culturales, la pobreza prevalente en zonas rurales dificulta que los habitantes puedan costear servicios legales adecuados. Además, la lejanía y falta de infraestructura judicial en estas regiones impiden un acceso oportuno a la justicia, exacerbando la sensación de exclusión entre sus pobladores. En las comunidades rurales existe un bajo nivel de confianza hacia el sistema judicial, debido a la percepción de corrupción y a la lentitud de los trámites burocráticos, lo que desmotiva a las personas a recurrir a la justicia ordinaria. Frente a esta situación, se han promovido alternativas como la justicia indígena y la figura de los jueces de paz. La Constitución del Ecuador reconoce la facultad de las autoridades indígenas para resolver disputas internas conforme a sus prácticas y tradiciones, fortaleciendo la cohesión comunitaria y el equilibrio social. De igual manera, desde el año 2015 los jueces de paz han atendido más de 15.000 casos en sectores rurales y urbano-marginales, ofreciendo un acceso a la justicia más directo, ágil y cercano a la ciudadanía. | es_ES |
