Resumen : El presente trabajo investigativo, permitirá al lector visualizar de una manera más profunda la problemática existente, esto es la negativa de aceptar la demanda o solicitud de extinción del patrimonio familiar por parte de los Juzgados Civiles o de familia dependientes del Consejo de la Judicatura, dando esa competencia exclusiva al servicio notarial donde se cobra tasas pos sus servicios es violatorio de Derechos Constitucionales de igualdad ante la Ley y de acceso a la justicia en forma gratuita. El artículo 851 del Código Civil norma la extinción del patrimonio familiar y la disposición reformatoria 16 del Código Orgánico General de Procesos otorga la facultad a los notarios de realizar la acción, pero no suprime la competencia de los juzgados………
Descripción : This investigative work, allow the reader to visualize in a deeper way the existing problematic, that is to say, the refusal to accept the demand or request for extinction of the family property by the Civil or Family Courts dependent on the Council of the Judiciary, giving This exclusive competence in the notarial service where copyright fees are charged on constitutional rights to equality before the law and access to justice for free. Article 851 of the Standard Civil Code in the extinction of family patrimony and in the reformatory arrangement 16 of the General Organic Code of Processes grants the power to notaries to carry out the action, but does not suppress the jurisdiction of the courts……
