| Resumen : | Esta investigación que es promovida con el ánimo de obtener el Título de Máster de Derecho Procesal, lleva por Título: “LA MEDIACIÓN COMO ETAPA PROCESAL EN EL ÁMBITO DE FAMILIA, NIÑEZ Y ADOLESCENCIA, PARA LA DESCONGESTIÓN JUDICIAL”, y es un tema que surge de la incertidumbre planteada como problema científico: ¿De ser implementada la mediación como vía directa de solución de conflictos dentro de la fase procesal en los casos de familia, niñez y adolescencia; podría obtenerse mayor descongestión judicial?. Esto conllevó mediante una metodología con enfoque cuali-cuantitativo a emplear métodos de investigación como el histórico, lógico, inductivo, deductivo, y usando como técnicas de investigación la encuesta y la entrevista, que fue aplicada a la población de abogados que conforma el Colegio de Abogados del Guayas, de donde se obtuvo la muestra encuestada…...... |
| Descripción : | This research, which is promoted with the aim of obtaining the Master's Degree in Procedural Law, is entitled: “MEDIATION AS A PROCEDURAL STAGE IN THE FIELD OF FAMILY, CHILDHOOD AND ADOLESCENCE, FOR JUDICIAL DEFROSTING”, and is an issue that arises of the problem posed as a scientific problem: If mediation is implemented as a direct means of conflict resolution within the procedural phase in the cases of family, childhood and adolescence; Could greater judicial decongestion be obtained? This led through a methodology with a qualitative-quantitative approach to employ research methods such as historical, logical, inductive, deductive, and using the survey as research techniques, which was applied to the population of lawyers that make up the Guayas Bar Association, where the surveyed sample was obtained………… |
