| Resumen : | El siguiente trabajo de investigación tiene por enfoque estudiar la prelación de la toma de decisiones por parte del juez al momento de escoger los curadores ad-litem dentro del divorcio litigioso, sustanciado dentro del procedimiento sumario. El alcance de la investigación partirá del Código Orgánico de la Niñez y Adolescencia, y se extenderá dentro de normas supletorias como lo son el Código Civil y Código Orgánico General de Procesos debido a que la problemática existente versa sobre la idoneidad del curador ad-litem. El curador ad-litem tiene la función de representar y proteger al menor, ya que no ha cumplido la mayoría de edad y es incapaz ante la ley poder representarse a sí mismo; es decir, posteriormente al juicio de divorcio litigioso, uno de los padres no está en la condición de prestar atención requerida al menor, el papel de los curadores designados se debe ejecutar conforme a la resolución dictada por el juzgador y estos deben velar por la educación, seguridad esencialmente ejercer todo lo concerniente al interés superior del menor........... |
| Descripción : | The following research is focused on studying the priority of decision-making by the judge when choosing ad-litem guardians within the disputed divorce, conducted within the summary procedure. The scope of the investigation will start from the Organic Code of Childhood and Adolescence, and will be extended within supplementary norms such as the Civil Code and General Organic Code of Processes because the existing problem concerns the suitability of the ad-litem curator. The guardian ad-litem has the function of representing and protecting the minor, since he has not reached the age of majority and is incapable of being able to represent himself before the law; In other words, after the litigious divorce trial, one of the parents is not in the condition to provide the required attention to the minor, the role of the appointed guardians must be executed in accordance with the resolution issued by the judge and they must ensure education , security essentially exercise everything concerning the best interests of the minor............... |
